We would like to point out that for the purpose of simplifying the shopping process and for the subsequent processing of the contract, the IP data of the connection owner are stored by the webshop operator within the framework of cookies, as are the name, address and credit card number of the purchaser in the online Shop.

After the cancellation of a purchase process, the data stored by us will be deleted. In the event of the conclusion of a contract, all data from the contractual relationship will be stored until the expiry of the retention period under tax law (10 years).

The data processing is carried out on the basis of the legal provisions of § 96 para 3 TKG as well as Art 6 para 1 lit a (consent) and/or lit b (necessary for the fulfilment of the contract) of the DSGVO.

Dieses Dokument stellt die allgemeinen Geschäfts-, Zahlungs- und Lieferbedingungen zur Verwendung im Geschäftsverkehr mit Kunden dar.

Im Folgenden wird das Osmium-Institut zur Inverkehrbringung und Zertifizierung von Osmium GmbH mit Sitz in Deutschland vereinfacht Osmium-Institut genannt.

Präambel:

Das Osmium-Institut zur Inverkehrbringung und Zertifizierung von Osmium GmbH hat die Aufgabe, international den Handel mit kristallinem Osmium zu regulieren und Handelsware zu zertifizieren, deren Echtheit zu prüfen und zu bestätigen sowie neu kristallisiertes Osmium erstmalig in den Verkehr zu bringen. 

Um diesen Zweck erfüllen zu können, unterhält die Osmium-Institut zur Inverkehrbringung und Zertifizierung von Osmium GmbH eine Datenbank mit sämtlichem ausgeliefertem Osmium. 

Die im Internet verfügbare Inverkehrbringungserläuterung ist Teil dieser AGB.

§1  Geltungsbereich

1. Die nachfolgenden allgemeinen Geschäftsbedingungen gelten für alle Lieferungen, Leistungen und Angebote im Namen und Abwicklung des Online Internet Shops des Osmium-Instituts im rechtsgeschäftlichen Verkehr mit Kunden. Kunden, respektive Verbraucher im Sinne der Geschäftsbedingungen sind natürliche oder juristische Personen, die mittels der Shop-Website des Osmium-Instituts durch Handel mit dem Osmium-Institut in Geschäftsbeziehung treten. Natürliche Personen in Europa müssen dabei das 18. Lebensjahr erreicht haben und geschäftsfähig sein. Im außereuropäischen Ausland gilt jeweils die Volljährigkeitsgrenze des jeweiligen Landes. 

2. Mit der Auftragserteilung, spätestens aber mit Entgegennahme der Leistung oder Lieferung des Osmium-Instituts erkennt der Kunde diese Bedingungen an. Gegenbestätigungen des Kunden unter Hinweis auf die Geltung seiner Geschäftsbedingungen wird hiermit widersprochen. Abweichungen von diesen Geschäftsbedingungen sind nur wirksam, wenn sie schriftlich vom Osmium-Institut bestätigt werden.

 

§2  Abwicklung, Lieferung, Gefahrenübergang

1.) Der Kunde beendet seine verbindliche Bestellung mit der Übermittlung  des ausgewählten Warenkorbes an das Osmium-Institut per Internet auf der Internetseite www.buy-osmium.com oder einer Partnerseite, die im Hintergrund der Seite an das Warenhaltungssystem der buy-osmium.com angebunden ist. Kunde ist in diesem Zusammenhang jeder Besteller, der die Internetplattform nutzt. Damit sind auch Handelspartner mit rabattierten Einkaufskonditionen im Sinne dieser AGB Kunden. 

2.) Die Waren sind in zwei Kluster aufgeteilt:

2a) Waren, die mit einer Warengruppe wie Osmium-Diamonds oder Osmium-Disks angehören und direkt nach dem angegebenen Gewicht bestellt werden können. In diesem Fall ist jedes Stück ein Unikat mit festen Maßen und festem Gewicht. Jedes Stück wird mit einem eigenen Preis angegeben. Für die Warengattung ist jeweils stellvertretend ein Bild zu sehen. Das Originalzertifizierungsbild ist nach dem Einkauf auf www.osmium-identification-code.com zu sehen, wenn der entsprechende Osmium-Identification-Code eingegeben wird.

2b) Paket-Waren, die nach dem zu bestellenden aktuellen Wert in Euro oder USD klassifiziert werden. Paket-Waren dieser Art beinhalten beliebige Stücke Osmium je nach Warenbestand im Lager des Osmium-Institutes. Es wird bei der Zusammenstellung jeweils die bestellte Masse oder der Warenwert am Auslieferungstag respektive Ausbuchungstag eingestellt. 

Die gelieferte Warenmenge wird diesen Wert bei Auslieferung immer übersteigen, ohne dass ein Aufpreis anfällt. Die Überliefermenge wird als Rabatt ausgewiesen. Partner mit eigenem Internetshop können ausschließlich, selbst erworbene Stücke oder Paket-Waren veräußern, da die Stücke im Paket selbst im Moment des Verkaufs noch unspezifiziert sind und deshalb nicht optioniert werden müssen. Ware, die durch einen Partner bereits erworben und bezahlt wurde kann im eigenen Shop eines jeden Partners auch spezifiziert angeboten werden. 

3.) Im Bestellvorgang wählt der Kunde die gewünschten Produkte, bestätigt im Bezahlvorgang die ausgewählte Ware und erhält vom Osmium-Institut eine Proformarechnung mit einer vorläufigen Rechnungsnummer per E-Mail. Die Proformarechnung wird im Bestellvorgang umgehend elektronisch versendet. 

4.) Die Wahl des Versandservice obliegt allein dem Osmium-Institut. Die Versandkosten im Inland trägt der Kunde. Sie sind in der Proformarechnung bereits ausgewiesen. In besonderen Fällen übernimmt der Versender Versicherung und Versandkosten, jedoch besteht durch einmalige Ausführung kein Anspruch auf eine Regelmäßigkeit.

5.) Bestellungen und deren Abwicklung sind 24 Stunden am Tag, an 7 Tagen der Woche gewährleistet. Die Auslieferung erfolgt ausschließlich werktags.

6.) Der Kunde überweist innerhalb von 3 Banktagen den bestätigten Kaufpreis ohne Abzüge auf das angegebene Bankkonto des Osmium-Instituts. Die Überweisung erfolgt in Euro.

7.) Nach Geldeingang erhält der Kunde vom Osmium-Institut eine Bestätigung des Geldeingangs, die Originalrechnung mit schlussendlicher und verbindlicher Rechnungsnummer. Der Kunde erhält eine Information über das voraussichtliche Versanddatum. Sollte der Gesamtbetrag noch nicht vollständig überwiesen sein, wird die Ware bis zur vollständigen Zahlung nicht ausgeliefert. 

8.) Lieferzeiten hängen vom Bestand an Lagerwaren und vom Komplexitätsgrad von neuen Formen ab. Die maximale Lieferzeit beträgt jedoch maximal drei Monate. Sie kann erreicht werden, wenn der Kristallisationszyklus sich Produktartbedingt verlängert. Sie kann nur bedingt beeinflusst werden. Ware, die im Institut vorliegt, wird spätestens innerhalb dreier Werktage versandt. 

Sollten Lieferzeiten den Zeitraum von drei Monaten überschreiben, so wird der Kunde mit Ablauf dieser Frist über die Lieferzeit informiert und erhält parallel ein Rücktrittsrecht.

9.) Sobald die Waren auf dem Versandweg sind, erhält der Kunde eine Versandbestätigung für die bestellte Ware per e-mail mit einem Code zur Nachverfolgung der Ware. Im Sonderfall der Direktauslieferung per Kurier wird ein Datum bekanntgegeben oder mit dem Kunden vereinbart, zu dem die Ware geliefert wird.

Die Vereinbarung verbindlicher Liefertermine bedarf der Schriftform. Sollte sich durch nicht beeinflussbare Umstände die Auslieferung der bestellten Ware verzögern, erhält der Kunde eine schriftliche Information.

Die Zustellung erfolgt durch ein Logistikunternehmen von Montag bis Freitag in Deutschland, Österreich oder im innereuropäischen Ausland. Die Lieferzeit beträgt für Lagerware in der Regel nicht mehr als 10 Werktage nach Geldeingang. Im außereuropäischen Ausland kann die Lieferung sich je nach den Einfuhrbestimmungen, der Zollabwicklung oder den Versandmethoden des Versenders erhöhen. Vor allem Schiffs- und Bahntransporte sind hiervon betroffen. 

10.) Der gesamte Warenwert der jeweiligen Sendung ist versichert. Es fallen pro Bestellung pauschale Bearbeitungsgebühren, inklusive versichertem Versand, laut Versandkostentabelle im Shop an.

Die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung des Liefergegenstands im Falle der Versendung geht erst mit Übergabe auf den Kunden über. Der Übergabe steht es gleich, wenn der Kunde im Annahmeverzug ist.

Bei Untergang der Ware oder Verschlechterung des Lieferzustandes hat das Osmium-Institut das Recht der Nachbesserung nach Rückversand der beschädigten Ware. Die hierdurch verlängerte Lieferzeit wird durch den Kunden akzeptiert.

Sämtliche Ware verlässt das Osmium-Institut nach einem gründlichen Qualitätscheck in der hierfür vorgesehenen Standardversand- und Präsentationsverpackung. Die Warenüberprüfung erfolgt in einem zweiten Schritt noch einmal bei Verpackung und wird für den Kunden im Pakten sowie elektronisch dokumentiert. 

Im Lieferumfang sind ein USB-Stick mit Daten zu Osmium, ein Kugelschreiber, eine Broschüre, ein Button und eine Lampe enthalten, die der Kunde kostenfrei im Lieferumfang erhält. Die Waren dienen der verbesserten Präsentation des Osmiums.

 

§3  Angebot, Preise und Vertragsabschluss

1. Die Angebote des Osmium-Instituts sind freibleibend und unverbindlich. Verträge kommen erst mit der Zahlung an das Osmium-Institut zustande. Das Osmium-Institut behält sich vor,  Aufträge die vom Kunden bei einem technischen Defekt des Shopsystems in Auftrag gegeben wurden, nicht auszuführen.

2. Als vereinbart gelten die am Tag und zur Zeit des Vertragsschlusses gültigen Preise in Euro zzgl. der jeweiligen gesetzlichen Mehrwertsteuer. Es gelten die Preise aus dem jeweils täglich veröffentlichten Osmium-Fixing, die auf der Seite www.osmium-preis.de bekannt gegeben werden. Die Seite wird durch das Osmium-Institut betrieben.

3. Es besteht kein Widerrufsrecht bei Fernabsatzverträgen über die Lieferung von Waren, deren Preis auf dem Finanzmarkt Schwankungen unterliegt, auf die der Unternehmer keinen Einfluss hat und die innerhalb der üblichen Widerrufsfrist auftreten können.

4. Erfolgt die Bestellung des Kunden auf elektronischem Wege, so wird das Osmium-Institut deren Eingang unverzüglich bestätigen. Die Eingangsbestätigung stellt noch keine verbindliche Annahme der Bestellung dar.

 

§4  Zahlungsbedingungen, Verzug, Gegenansprüche, Ausliefermenge

1. Der Rechnungsbetrag ist sofort nach Eingang der Rechnung ohne Abzüge fällig und zahlbar. Zahlt der Kunde nicht innerhalb von drei Valutatagen ab Fälligkeit, kommt er ohne Mahnung in Verzug. Der Kunde hat während des Verzugs die Geldschuld in Höhe von 6 % über dem Basiszinssatz zu verzinsen.

2. Zahlungen gelten erst dann als geleistet, wenn das Osmium-Institut verlustfrei und abzugsfrei über den Betrag auf dem Bankkonto des Osmium-Instituts verfügen kann.

3. Die Ausübung eines Zurückbehaltungsrechts gegenüber dem Entgelt durch den Kunden ist ausgeschlossen, soweit das Zurückbehaltungsrecht nicht auf demselben Vertragsverhältnis beruht. Ein Aufrechnungsrecht steht dem Kunden nur für den Fall zu, dass eine Gegenforderung rechtskräftig festgestellt, unbestritten oder durch das Osmium-Institut anerkannt ist.

4. Sofern ein Produkt mit einem festen Gewicht im Shop angegeben wurde und es sich auf ein definiertes Stück handelt, wird exakt dieses angebotene Stück zur Auslieferung gebracht. 

5. Wenn ein Produkt mit dem Mindestgewicht einer Produktklasse angeboten wird, ist das Osmium-Institut berechtigt ein Stück auszuwählen, welches ein höheres Gewicht besitzt. Eine Differenzzahlung für die Übermenge darf das Osmium-Institut in diesem Fall nicht verlangen. 

6. Im besonderen Fall, dass Untermengen einer gewünschten Produktgruppe zur Auslieferung kommen sollen, kann das Osmium-Institut bei zu wenig Lagerbestand an exakt zuweisbaren Gewichten auch bei bis zu 10% Abweichung des Gewichtes nach unten ausliefern, ist jedoch verpflichtet, die Abweichung in Form von Osmium-Stars, Osmium-Starrows oder Osmium-Diamonds aufzufüllen. Dabei gilt jeweils der Verkaufspreis der bearbeiteten Diamonds und Stars auch wenn die Masse des ausgelieferten Osmiums dann nach unten abweicht, da die genannten Produkte Fertigungskosten im Schnitt zur Folge haben.

 

§5  Eigentumsvorbehalt

1. Die gelieferte Ware bleibt bis zur vollständigen Zahlung des Entgeltes und aller bestehenden Forderungen aus der Geschäftsverbindung mit dem Kunden das Eigentum des Osmium-Instituts oder des verkaufenden Händlers. 

2. Der Kunde ist verpflichtet, dem Osmium-Institut einen Zugriff Dritter auf den Liefergegenstand, etwa im Falle der Pfändung, sowie sonstige Beschädigungen, oder die Vernichtung, oder einen Besitzwechsel unverzüglich mitzuteilen.

Das Osmium-Institut ist berechtigt, bei vertragswidrigem Verhalten des Kunden, insbesondere bei Zahlungsverzug, oder einer der vorstehend genannten Verpflichtungen vom Vertrag zurückzutreten und den Liefergegenstand heraus zu verlangen.

 

§6  Gewährleistung

1. Der Kunde hat zunächst die Wahl, ob Nacherfüllung durch Nachbesserung oder Ersatzanlieferung erfolgen soll. Das Osmium-Institut ist jedoch berechtigt, die Art der gewählten Nacherfüllung zu verweigern, wenn sie nur mit unverhältnismäßigen Kosten möglich ist und die andere Art der Nacherfüllung ohne erhebliche Nachteile für den Verbraucher bleibt. Es besteht kein Anspruch auf eine definierte Kristallisationsstruktur. 

2. Schlägt die Nacherfüllung fehl, kann der Vertragspartner, unbeschadet weitergehender Schadenersatzan- sprüche, vom Vertrag zurücktreten, oder die Vergütung mindern. Bei nur geringfügigen Mängeln steht dem Kunden jedoch kein Rücktrittsrecht zu.

Wählt der Kunde und Vertragspartner nach gescheiterter Nacherfüllung den Rücktritt vom Vertrag, steht ihm daneben kein Schadenersatzanspruch wegen des Mangels zu. Wählt der Kunde oder Vertragspartner nach gescheiterter Nacherfüllung Schadenersatz, so verbleibt der Vertragsgegenstand, sofern zumutbar, bei ihm. 

Der Schadensersatz beschränkt sich auf die Differenz zwischen Kaufpreis und Wert der mangelfreien Sache.

3. Der Kunde hat dem Osmium-Institut innerhalb einer Frist von drei Tagen ab dem Zeitpunkt, zu dem der vertragswidrige Zustand des Liefergegenstands festgestellt wurde, über offensichtliche Mängel schriftlich zu unterrichten und Fotografien beizufügen, die den Mangel unter Beweis stellen. Dabei ist eine ungleichmäßige Kristallisierung nicht als Mangel zu sehen, da die Kristallisationsausprägung nicht beeinflusst werden kann.

Maßgeblich für die Wahrung der Frist ist der Zugang der Unterrichtung beim Osmium-Institut. Unterlässt der Kunde diese Unterrichtung, erlöschen die Gewährleistungsrechte zwei Monate nach Feststellung des Mangels. Dies gilt nicht bei Arglist seitens des Osmium-Instituts oder Händlers. Die Beweislast für den Zeitpunkt der Feststellung des Mangels trifft den Kunden.

 

§7  Haftungsbegrenzung, Schadenersatzansprüche

1. Schadens- und Aufwendungsersatzansprüche des Kunden, gleich aus welchem Rechtsgrund, insbesondere wegen Verletzung von Pflichten aus dem Schuldverhältnis und unerlaubter Handlung, sind ausgeschlossen.

2. Dies gilt nicht, soweit zwingend gehaftet wird, zum Beispiel nach dem Produkthaftungsgesetz, in Fällen des Vorsatzes, der groben Fahrlässigkeit oder wegen der Verletzung wesentlicher Vertragspflichten. Eine Änderung der Beweislast zum Nachteil des Vertragspartners ist mit den vorstehenden Regelungen nicht verbunden.

 

§8  Geldwäsche


1. Als internationales Handelsunternehmen werden strikt alle Gesetze zur Geldwäschebekämpfung und Bekämpfung der Terrorismusfinanzierung befolgt.

2. Vor Auslieferung der Ware wird die Identifikation des Vertragspartners und die plausible Darstellung der Mittelherkunft überprüft. Zudem wird der Status als „politisch exponierte Person“ abgefragt.

3. Zur Überprüfung der Identifikation eines Kunden, respektive Vertragspartners wird bei allen Käufen mit einem Wert ab 2.000 € die Übermittlung einer Kopie eines gültigen Personalausweises oder Reisepasses angefordert. 

Bei juristischen Personen wird neben dem Handelsregisterauszug oder dem Gewerbeschein die Identität des wirtschaftlichen Eigentümers der Unternehmung gemäß den geltenden Geldwäschebestimmungen benötigt. Sollten in anderen Ländern diese Bestimmungen abweichen, wird den Gesetzgebungen zur Geldwäsche im Zielland gefolgt.

4. Gemäß den geltenden Geldwäschebestimmungen muss die Mittelherkunft plausibel und lückenlos dargestellt werden.

5. Gemäß den geltenden Geldwäschebestimmungen wird der PEP Status (Politisch exponierte Person) abgefragt. 

6. Nach KSchG § 5 f (2) besteht kein Widerrufsrecht bei Fernabsatzverträgen über die Lieferung von Waren, deren Preis auf dem Finanzmarkt Schwankungen unterliegt, auf die der Unternehmer keinen Einfluss hat und die innerhalb der üblichen Widerrufsfrist auftreten können.  

7. Ausnahmen vom Widerrufsrecht: 

Das Widerrufsrecht besteht nicht bei den folgenden Verträgen (§ 312 g des BGB): 


a) zur Lieferung von Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind.


b) Verträge zur Lieferung von Waren oder zur Erbringung von Dienstleistungen, einschließlich Finanzdienstleistungen, deren Preis von Schwankungen auf dem Finanzmarkt abhängt, auf die der Unternehmer keinen Einfluss hat und die innerhalb der Widerrufsfrist auftreten können, insbesondere Dienstleistungen im Zusammenhang mit Aktien, mit Anteilen an offenen Investmentvermögen im Sinne von § 1 Absatz 4 des Kapitalanlagegesetzbuchs und mit anderen handelbaren Wertpapieren, Devisen, Derivaten oder Geldmarktinstrumenten.

 

§9  Datenschutz

1. Gemäß dem Datenschutzgesetz wird darauf aufmerksam gemacht, dass im Rahmen der Geschäftsabwicklung notwendige Daten mittels EDV verarbeitet und gespeichert werden.  Kundendaten werden durch das Osmium-Institut nicht weitergegeben und können von niemandem eingesehen werden. Sie werden ausschließlich zur Abwicklung der Bestellung und eigener  Marketingzwecke per Newsletter oder für Angebote zum Rückkauf von Waren genutzt.

 

§10  Schlussbestimmungen

1. Als Erfüllungsort gilt der Firmensitz des Osmium-Instituts. Gerichtstand ist München. Es gilt Deutsches Recht. Auch bei Lieferungen ins Ausland findet ausschließlich Deutsches Recht Anwendung.

2. Sollte eine dieser Bestimmungen ganz oder zum Teil unwirksam sein, so wird hiervon die Gültigkeit der anderen Bestimmungen nicht berührt. An die Stelle der unwirksamen Bestimmung tritt eine Bestimmung, die dem Geist der Vereinbarung entspricht.

This document sets out the general terms and conditions of business, payment and delivery for use in business transactions with customers. 

To simplify the following, the Osmium-Institut zur Inverkehrbringung und Zertifizierung von Osmium GmbH (located in Germany, Baierbrunn) will be referred to as Osmium-Institute.

Preamble: 

The Osmium Institut zur Inverkehrbringung und Zertifizierung von Osmium GmbH has the task to regulate the international trade with crystalline osmium and to certify goods, to check and confirm their authenticity as well as to market newly crystallized osmium for the first time. 

In order to fulfil this purpose, the Osmium Institut zur Inverkehrbringung und Zertifizierung von Osmium GmbH maintains a database with all delivered osmium. 

The market introduction explanation available on the internet is part of these GTC.

§1 Scope of application

The following general terms and conditions apply to all deliveries, services and offers in the name and handling of the online internet shop of the Osmium-Institute in legal transactions with customers. Customers, respectively consumers in the sense of the terms and conditions are natural or legal persons who enter into a business relationship with the Osmium-Institute through trade via the shop website of the Osmium-Institute. Natural persons in Europe must have reached the age of 18 and be legally competent. In non-European countries, the age of legal capacity of the respective country applies. 

The customer acknowledges these conditions with the placing of the order, at the latest however with the acceptance of the service or delivery of the Osmium-Institute. Counter-confirmations of the customer with reference to the validity of his terms and conditions are hereby contradicted. Deviations from these terms and conditions are only effective if they are confirmed in writing by the Osmium-Institute. 

§2 Processing, Delivery, Transfer of Risk

1. The customer completes his binding order with the submission of the selected shopping cart to the Osmium Institute via the internet on the website www.buy-osmium.com or a partner site, which is connected to the merchandise management system of buy-osmium.com. In this context, every purchaser who uses the internet platform is a customer. Thus, also trade partners with discounted purchase conditions in the sense of these GTC are customers. 

2. The goods are separated into two clusters:

2a Goods which belong to a group of goods such as Osmium Diamonds or Osmium Disks and can be ordered directly according to the weight indicated. In this case each piece is unique with fixed dimensions and fixed weight. Each piece is indicated with its own price. For each type of good a picture is shown as a representative. The original certification picture can be seen after purchase on www.osmium-identification-code.com, if the corresponding osmium identification code is entered.

2b Packaged goods, which are priced in EUR or USD according to their current order value. Package goods of this type contain arbitrary pieces of osmium depending on the stock in the warehouse of the Osmium-Institute. The ordered mass or the value of the goods is set during the compilation on the day of delivery or the day of check-out. 

The delivered quantity of goods will always exceed this value on delivery without any surcharge. The excess delivery quantity is shown as a discount. Partners with their own internet shop can only sell pieces or parcels they have purchased themselves, as the pieces in the parcel itself are still unspecified at the time of sale and therefore do not have to be optioned. Goods that have already been purchased and paid for by a partner can also be offered as specified in the partner`s own shop. 

3. In the ordering process, the customer selects the desired products, confirms the selected goods in the payment process and receives a pro forma invoice from the Osmium-Institute with a provisional invoice number by e-mail. The pro forma invoice is sent electronically immediately during the ordering process. 

4. The Osmium-Institute is solely responsible for choosing the shipping service. The customer shall cover the domestic shipping costs. They are already shown in the pro forma invoice. In exceptional cases, the shipper will take over insurance and shipping costs, but there is no claim to regularity due to one-time execution.

5. Orders and their processing are guaranteed 24 hours a day, 7 days a week. The delivery takes place exclusively on weekdays.

6. The customer transfers the confirmed purchase price without deductions to the bank account of the Osmium-Institute within 3 banking days. The transfer will be made in Euro.

7. After receipt of the money, the customer will receive a confirmation of receipt from the Osmium-Institute, the original invoice with final and binding invoice number. The customer receives information about the expected shipping date. If the total amount has not yet been paid in full, the goods will not be delivered until payment has been made in full. 

8. Delivery times depend on the stock of stock goods and the degree of complexity of new shapes. However, the maximum delivery time is three months. It can be achieved if the crystallization cycle is extended due to the type of product. It can only be influenced to a limited extent. Goods available at the institute are shipped within three working days at the latest. 

If delivery times exceed the period of three months, the customer will be informed of the delivery time at the end of this period and will also receive a right of withdrawal.

9. As soon as the goods are on their way, the customer receives a shipping confirmation for the ordered goods by e-mail with a code to track the goods. In the special case of direct delivery by courier, a date is announced or agreed on with the customer on which the goods are delivered.

The agreement of binding delivery dates must be made in writing. Should the delivery of the ordered goods be delayed due to circumstances beyond the customer`s control, the customer shall receive written information.

The delivery is carried out by a logistics company from Monday to Friday in Germany, Austria or in other European countries. The delivery time for goods in stock is usually no more than 10 working days after receipt of payment. In non-European countries the delivery can increase depending on the import regulations, the customs clearance or the dispatch methods of the shipper. This particularly affects shipping and rail transport. 

10. The total value of the respective shipment is insured. Flat handling charges apply per order, including insured shipping, according to the shipping table in the shop.

The risk of accidental loss and accidental deterioration of the delivery item in the event of shipment shall only pass to the customer upon handover. It shall be equivalent to the handover if the customer is in default of acceptance.

In case of loss of the goods or deterioration of the delivery condition, the Osmium-Institute has the right of rectification after return of the damaged goods. The thereby extended delivery time is accepted by the customer.

All goods leave the Osmium Institute after a thorough quality check in the standard shipping and presentation packaging provided for this purpose. The quality check of the goods is carried out again in a second step at the time of packaging and is documented for the customer in the package and electronically. 

The delivery includes a USB stick with data on osmium, a ballpoint pen, a brochure, a button and a lamp, which the customer receives free of charge. These items serve to improve the presentation of the osmium

§3 Offer, Prices and Execution of Contract

Offer, Prices and Execution of Contract

1. The offers of the Osmium-Institute are subject to confirmation and non-binding. Contracts are not concluded until payment has been made to the Osmium-Institute. The Osmium-Institute reserves the right not to carry out orders which have been placed by the customer due to a technical defect of the shop system.

2. The prices in Euro valid on the day and at the time of the conclusion of the contract plus the respective statutory value added tax shall be deemed to have been agreed. The prices from the daily published osmium fixings, which are announced on the website www.osmium-preis.de, apply. The site is operated by the Osmium-Institute.

3. There is no right of revocation in distance contracts for the delivery of goods whose price is subject to fluctuations on the financial market, over which the supplier has no influence and which may occur within the usual revocation period.

4. If the customer places an order electronically, the Osmium-Institute will immediately confirm receipt thereof. The confirmation of receipt does not constitute a binding acceptance of the order. 

§4 Terms of Payment, Default, Counterclaims, Delivery Quantity

1. The invoice amount is due and payable immediately after receipt of the invoice without deductions. If the customer does not pay within three value dates from the due date, he will be in default without a reminder. The customer must pay interest on the debt at a rate of 6% above the base rate during the default period.

2. Payments shall only be deemed to have been made when the Osmium-Institute can dispose of the amount on the bank account of the Osmium-Institute without loss or deduction.

3. The exercise of a right of retention against the payment by the customer is excluded, as far as the right of retention is not based on the same contractual relationship. The customer is only entitled to an offset right in the event that a counterclaim is legally established, undisputed or recognized by the Osmium-Institute.

4. If a product with a fixed weight was stated in the shop and it is a defined piece, exactly this offered piece will be delivered. 

5. If a product with the minimum weight of a product class is offered, the Osmium-Institute is entitled to select a piece which has a higher weight. In this case, the Osmium-Institute may not demand a differential payment for the excess quantity. 

6. In the special case that sub-quantities of a desired product group are to be delivered, the Osmium-Institute can, in the case of insufficient stock of precisely assignable weights, also deliver with up to 10% deviation of the weight downwards, but is obliged to replenish the deviation in the form of Osmium Stars, Osmium Starrows or Osmium Diamonds. The sales price of the processed diamonds and stars applies even if the mass of the osmium delivered then deviates downwards, as the products mentioned entail production costs from cutting. 

§5 Retention of ownership

1. All delivered goods remain in the ownership of the Osmium-Institute or the selling retailer until the complete payment of the fee and all existing claims from the business relationship with the customer. 

The customer is obliged to inform the Osmium-Institute immediately of any access of third parties to the delivery item, e.g. in case of seizure, as well as any other damage, destruction or change of ownership.

The Osmium-Institute is entitled to withdraw from the contract and to demand the return of the delivery item in case of breach of contract by the customer, in particular in case of default of payment, or one of the aforementioned obligations.

§6 Warranty

1 The customer shall initially have the choice of whether subsequent performance is to take the form of rectification or replacement delivery. However, the Osmium-Institute is entitled to refuse the type of supplementary performance chosen if it is only possible with disproportionate costs and the other type of supplementary performance remains without considerable disadvantages for the consumer. There is no claim to a defined crystallization structure. 

2. If the supplementary performance fails, the contractual partner may - without prejudice to further claims for damages - withdraw from the contract or reduce the remuneration. In the case of only minor defects, however, the customer shall not be entitled to withdraw from the contract.

If the customer and contractual partner choose to withdraw from the contract after failed subsequent performance, he shall not be entitled to any additional claim for damages due to the defect. If the customer or contractual partner chooses compensation for damages after failed subsequent performance, the subject matter of the contract shall, if reasonable, remain with him. 

Compensation is limited to the difference between the purchase price and the value of the defect-free item.

3. The customer has to inform the Osmium-Institute in writing about obvious defects within a period of three days from the point in time at which the condition of the delivery item contrary to the contract was determined and to attach photographs which prove the defect. In this case an uneven crystallization is not to be seen as a deficiency, since the characteristic of crystallization cannot be influenced.

The receipt of the information by the Osmium-Institute is decisive for compliance with the deadline. If the customer fails to provide this information, the warranty rights expire two months after the defect has been discovered. This does not apply in case of fraudulent intent on the part of the Osmium-Institute or the retailer. The burden of proof for the time of the discovery of the defect lies with the customer.

§7 Limitation of liability, claims for damages

Claims for damages and compensation for expenses of the customer, irrespective of the legal basis, in particular due to breach of duties arising from the contractual obligation and unlawful acts, are excluded.

This shall not apply in the case of mandatory liability, e.g. under the Product Liability Act, in the case of intent, gross negligence or breach of fundamental contractual obligations. A change in the burden of proof to the detriment of the contractual partner is not associated with the above provisions.

§8 Money laundering

1. As an international trading company, we strictly comply with all anti-money laundering and anti-terrorist financing laws.

2. Prior to the delivery of goods, we check the identity of the contractual partner and the plausible representation of the source of funds. Furthermore, we check the PEP status. (politically exposed person).

3. In order to verify the identification of a customer or contractual partner, a copy of a valid identity card or passport (in the case of legal entities, the identity of the beneficial owner) is required for all purchases with a value of €2,000 or more in accordance with the applicable money laundering regulations.

4. In accordance with the applicable money laundering regulations, the source of funds must be presented in a plausible and complete manner.

5. The PEP status (politically exposed person) is queried in accordance with the applicable money laundering provisions. 

6. According to KSchG § 5 f (2), there is no right of withdrawal for distance contracts for the delivery of goods, the price of which is subject to fluctuations on the financial market over which the entrepreneur has no influence and which can occur within the usual withdrawal period.

7. Exceptions to the right of withdrawal: 

The right of withdrawal does not exist for the following contracts (§ 312 g of BGB):          

a) for the delivery of goods which are not prefabricated. An individual selection or purpose determined by the consumer is decisive for their manufacture, or they are clearly tailored to the personal needs of the consumer,                                              

b) contracts for the delivery of goods or the provision of services, including financial services, the price of which depends on fluctuations in the financial market over which the entrepreneur has no influence and which can occur within the withdrawal period, in particular services in connection with stocks, with shares in outstanding investment funds according to § 1 paragraph 4 of the German Investment Code and with other tradable securities, foreign currencies, derivatives or money market instruments.

§9 Data protection

1. In accordance with the data protection law, attention is drawn to the fact that necessary data in the context of business dealings is processed and stored by means of EDP. Customer data will not be passed on by the Osmium-Institute and cannot be viewed by anyone. It is used exclusively for the handling of the order, own marketing purposes by newsletter and/or for offers for the repurchase of goods.

§10 Final clauses

1 The place of fulfilment shall be the registered office of the Osmium-Institute. The place of jurisdiction is Munich. German law applies. Also, in the case of deliveries abroad, German law shall apply exclusively.

2 Should one of these provisions be invalid in whole or in part, this shall not affect the validity of the other provisions. The invalid provision shall be replaced by a provision which corresponds to the intent of the agreement.

Company names and domain names as well as designations as trading partners or tipsters in the association of Osmium Institutes

Partners in the circle of Osmium traders and tipsters are free to choose a company name or domain name that also includes the term Osmium and that describes the trader's task and activities. This confirmation therefore applies to company names, signage, product labels, information in brochures, information on merchandising, information in addresses, information in the imprint, information on business cards, statements on the phone as well as names of social media channels and video channels, such as Facebook, Instagram, youtube and others, as well as group names in messenger services such as Signal, Whatsapp or Telegram. Media not mentioned and media that will be created in the future are included.

 

Excluded from naming are those signs and names which are not capable of being represented to the public in such a way that the competent authorities and the public can clearly and unambiguously determine the subject matter of the protection. Osmium institutes can refuse delivery if excluded characters, company names or domains are used.

Those characters, company names and domains are excluded from use, which:

  • are devoid of any distinctive character for the goods or services,
  • consist exclusively of signs or indications which may serve, in trade, to designate the kind, quality, quantity, intended purpose, value, geographical origin, time of production of the goods or of rendering of the services, or other characteristics of the goods or services,
  • consist exclusively of signs or indications which have become customary in the current language or in the bona fide and established practices of the trade to designate the goods or services,
  • are likely to mislead the public, in particular as to the nature, quality or geographical origin of the goods or services,
  • are contrary to public order or morality,
  • contain state coats of arms, names of states or countries, state flags or other state emblems or coats of arms of a domestic place or a domestic association of municipalities or further associations of municipalities,
  • contain official test or guarantee marks or give the impression of being official test or guarantee marks,
  • contain coats of arms, flags or other marks, seals or designations of international intergovernmental organisations,
  • are excluded from registration under German law, under European Union law or under international agreements to which the European Union or the Federal Republic of Germany is a party and which protect designations of origin and geographical indications,
  • the use of can apparently be prohibited under other regulations in the public interest, or which have been registered or used in bad faith.
  • Osmium institutes reserve the right, in the event of a breach of these guidelines, to discontinue the supply of osmium as well as commissioning and also to suspend or even completely prevent the option of use of text and image rights. In order to prevent possible discrepancies and costs, it is therefore suggested in disputed cases to obtain a usage release from the "Osmium-Institut zur Inverkehrbringung und Zertifizierung von Osmium GmbH".
